MYCOPHENOLATE MOFETIL CONVERSION OR ADDITION IN PATIENTS WITH RENAL ALLOGRAFTS Altaca G, Aydin C, Berber I, Aydin M, Yalti T, Gul O, Emrebak E, Turkmen F, Ozel Y, Titiz I Haydarpasa Research and Teaching Hospital, Department of Transplantation, Istanbul, Turkey Mycophenolate mofetil MMF ; is a relatively new immunosuppressive drug, known to be superior to azathioprine in reducing the rates of acute and chronic rejection with less side effects, and preventing progressive renal failure in renal transplant patients. The aim of the study was to evaluate the effects of conversion to or addition of mycophenolate mofetil MMF ; in renal transplant patients. Forty-three patients in whom MMF was started at least one month after the transplant were included in the study. The reasons for starting MMF were azathioprine or Cyclosporine-A CSA ; toxicity, and inadequate graft function with or without acute or chronic rejection. The parameters analysed were acute and chronic rejection rates, creatinin levels, daily requirements of CSA before and after the MMF therapy. In addition, side effects of MMF were evaluated. Mean age of the patients were 32.95 10.65 yrs. Donors were cadaveric in 12 and livingrelated in 31 patients. Induction immunosuppressive therapy consisted of steroids, CSA, and azathioprine in 13; steroids, CSA, azathioprine, and antilymphocyte therapy in 15; and steroids and CSA in 5 patients. MMF was started at a mean of 36.4 32 months posttransplant and the mean follow-up period after MMF therapy was 10.8 8.1 months. Mean initial dose, mean maximal dose during treatment, and mean doses of MMF at the last follow-up were 1565 515 mg, 1907 412 mg, 1512 505 mg, respectively. The reasons for initiation of MMF were inadequate graft function in 16 37 % ; , chronic rejection in 12 28% ; , elevated liver function tests in HCV-positive patients on azathioprine therapy in 11 26% ; , acute rejection in 7 16% ; , CSA nephrotoxicity, intolerance or fluctuant CSA levels in 3 7 % ; , CSA toxicity other than nephrotoxicity in 11 26% ; , malignant or premalignant conditions in 2 4.7% ; patients. After finding the existence of a contract, arrangement, or understanding, and determining the relevant market, it is necessary to show that a provision of the contract, arrangement or understanding has the purpose, effect, or likely effect of substantially lessening competition in that market. In the OSNZ case, the parties had argued that their behaviour was motivated by concern that the proposal of the Australian ophthalmologist had not provided for the necessary ongoing postoperative care, and so would jeopardise patient safety. The Court did not accept that this was the reason for the conduct of the parties as none of them knew the exact nature of the proposal which had provided for postoperative care ; , and much of the communications from the parties had emphasised the necessity for Southern Health to have offered the surgery to the incumbent surgeon, or to have sought his approval before offering it to others. However s27 raises further issues which indicate that it is unwise to rely on the argument that there were good reasons for the conduct such as patient safety ; , in order to escape liability. Firstly, the reason for engaging in conduct which may differ as between the parties ; is not the same as the purpose of that conduct. Purpose is defined as object or aim, such that `the conduct producing the consequences was motivated or inspired by a wish for the occurrence of the consequences.'11 The object or aim of the parties in the OSNZ case was to prevent the entry of the Australian ophthalmologist, whatever the reasons of the individual parties for desiring this outcome. Secondly, the Act does not require the anti-competitive purpose to be the only purpose.12 It is sufficient that it is a substantial purpose. So, even if the court had accepted that a purpose was to prevent risks to patient safety, it was sufficient that the purpose of preventing entry to the market was a substantial one. The parties in the OSNZ case would have behaved quite differently if they did not have an anticompetitive purpose. Thirdly, even if an anti-competitive purpose cannot be shown, s27 will still be contravened if the contract, arrangement, or understanding has the effect or likely effect of substantially lessening competition. It is important therefore that practitioners and practitioner associations and societies which have concerns about patient safety.
